Distance Sales Agreement

1. Parties

Seller (Service Provider):

Buyer (User): The individual who accepts this agreement by purchasing a subscription through the Baby Timeline mobile application.

2. Subject of the Agreement

This Agreement governs the terms and conditions for the sale and delivery of the Baby Timeline Premium digital subscription service. The agreement is established electronically between the Service Provider and the Buyer, in accordance with applicable consumer protection and electronic commerce regulations.

3. Product / Service Information

  • Service Name: Baby Timeline Premium Subscription
  • Service Type: Digital Content / Mobile Application Service
  • Description: Premium features including unlimited baby tracking, advanced growth charts, detailed statistics, journal with unlimited photos, backup & sync, and ad-free experience.
  • Delivery Method: Instant digital delivery upon purchase confirmation
  • Platform: iOS (App Store) and Android (Google Play Store)

4. Subscription Plans & Pricing

Baby Timeline offers the following subscription plans:

  • Monthly Plan: Billed every 30 days
  • Annual Plan: Billed every 365 days (discounted rate)

All prices are displayed in the user's local currency within the application before purchase. Prices include applicable taxes unless otherwise stated. Pricing may vary by region and is determined by Apple App Store and Google Play Store.

5. Payment Terms

  • All payments are processed securely through Apple App Store or Google Play Store.
  • Two Type Studio does not directly collect, store, or process any payment card information.
  • Payment is charged to the user's Apple ID or Google Play account upon purchase confirmation.
  • Subscriptions are billed in advance for each billing period.

6. Auto-Renewal & Cancellation

  • Subscriptions automatically renew at the end of each billing period unless the user cancels at least 24 hours before the current period expires.
  • The renewal charge is applied within 24 hours of the end of the current period.
  • Users can manage and cancel subscriptions at any time through:
    • iOS: Settings → Apple ID → Subscriptions
    • Android: Google Play Store → Menu → Subscriptions
  • Cancellation takes effect at the end of the current billing period. Users retain access to premium features until the period ends.

7. Free Trial

Baby Timeline may offer a free trial period for new subscribers. Details of the free trial:

  • Trial duration and eligibility are displayed before purchase.
  • If the user does not cancel before the trial ends, the subscription automatically converts to a paid subscription.
  • Free trials are available once per Apple ID or Google Play account.
  • Any unused portion of the free trial is forfeited upon purchasing a subscription.

8. Right of Withdrawal

As Baby Timeline Premium is a digital service that is delivered and performed instantly upon purchase:

  • As a digital service that begins immediately upon purchase, the right of withdrawal does not apply in accordance with applicable consumer protection regulations regarding digital content.
  • By completing the purchase, the Buyer acknowledges and agrees that the digital service is delivered immediately and waives the right of withdrawal.

For refund requests, users may contact Apple or Google directly through their respective support channels, as payments are processed by these platforms.

9. Service Availability

  • Two Type Studio aims to provide uninterrupted service but does not guarantee 100% uptime.
  • Scheduled maintenance and updates may temporarily affect service availability.
  • The Service Provider reserves the right to modify, update, or discontinue features with reasonable notice.

10. User Responsibilities

  • Users must be at least 13 years old or have parental consent.
  • Users are responsible for maintaining the security of their accounts.
  • The service must be used in accordance with applicable laws and the Terms of Use.
  • The user acknowledges that Baby Timeline is for informational and tracking purposes only and not a substitute for professional medical advice.

11. Liability

  • Growth data and developmental information are for reference purposes and may vary.
  • Two Type Studio is not liable for health decisions made based on the app's data. Consult a pediatrician for any health concerns.
  • Maximum liability is limited to the amount paid for the subscription in the preceding 12 months.

12. Dispute Resolution

  • Any disputes arising from this Agreement shall be resolved through mutual negotiation.
  • If negotiation fails, disputes shall be resolved through binding arbitration or the competent courts in the jurisdiction of the Service Provider.
  • This Agreement is governed by applicable international consumer protection laws.

2. Sözleşmenin Konusu

Bu Sözleşme, Baby Timeline Premium dijital abonelik hizmetinin satışı ve teslimine ilişkin hüküm ve koşulları düzenler. Sözleşme, yürürlükteki tüketici koruma ve elektronik ticaret mevzuatına uygun olarak Hizmet Sağlayıcı ile Alıcı arasında elektronik ortamda kurulmuştur.

3. Ürün / Hizmet Bilgileri

  • Hizmet Adı: Baby Timeline Premium Abonelik
  • Hizmet Türü: Dijital İçerik / Mobil Uygulama Hizmeti
  • Açıklama: Sınırsız bebek takibi, gelişmiş büyüme grafikleri, detaylı istatistikler, sınırsız fotoğraflı günlük, yedekleme ve senkronizasyon ve reklamsız deneyim gibi premium özellikler.
  • Teslimat Yöntemi: Satın alma onayı üzerine anında dijital teslimat
  • Platform: iOS (App Store) ve Android (Google Play Store)

4. Abonelik Planları ve Fiyatlandırma

Baby Timeline aşağıdaki abonelik planlarını sunmaktadır:

  • Aylık Plan: Her 30 günde bir faturalandırılır
  • Yıllık Plan: Her 365 günde bir faturalandırılır (indirimli fiyat)

Tüm fiyatlar, satın alma öncesinde uygulamada kullanıcının yerel para biriminde gösterilir. Aksi belirtilmedikçe fiyatlara geçerli vergiler dahildir. Fiyatlar bölgeye göre değişiklik gösterebilir ve Apple App Store ile Google Play Store tarafından belirlenir.

5. Ödeme Koşulları

  • Tüm ödemeler Apple App Store veya Google Play Store üzerinden güvenli şekilde işlenir.
  • Two Type Studio, hiçbir ödeme kartı bilgisini doğrudan toplamaz, saklamaz veya işlemez.
  • Ödeme, satın alma onayı üzerine kullanıcının Apple ID veya Google Play hesabına yansıtılır.
  • Abonelikler her faturalama dönemi için peşin olarak faturalandırılır.

6. Otomatik Yenileme ve İptal

  • Abonelikler, kullanıcı mevcut dönem sona ermeden en az 24 saat önce iptal etmedikçe her faturalama döneminin sonunda otomatik olarak yenilenir.
  • Yenileme ücreti, mevcut dönem bitiminden itibaren 24 saat içinde uygulanır.
  • Kullanıcılar aboneliklerini istediği zaman şu şekilde yönetebilir ve iptal edebilir:
    • iOS: Ayarlar → Apple ID → Abonelikler
    • Android: Google Play Store → Menü → Abonelikler
  • İptal, mevcut faturalama döneminin sonunda yürürlüğe girer. Kullanıcılar dönem sonuna kadar premium özelliklere erişim sağlar.

7. Ücretsiz Deneme

Baby Timeline yeni aboneler için ücretsiz deneme süresi sunabilir:

  • Deneme süresi ve uygunluk koşulları satın alma öncesinde gösterilir.
  • Kullanıcı deneme süresi sona ermeden iptal etmezse, abonelik otomatik olarak ücretli aboneliğe dönüşür.
  • Ücretsiz denemeler Apple ID veya Google Play hesabı başına bir kez geçerlidir.
  • Abonelik satın alındığında kullanılmayan deneme süresi geçersiz olur.

8. Cayma Hakkı

Baby Timeline Premium, satın alma üzerine anında teslim edilen ve ifa edilen bir dijital hizmet olduğundan:

  • Satın alma ile birlikte anında teslim edilen dijital içeriklere ilişkin geçerli tüketici koruma düzenlemeleri uyarınca cayma hakkı uygulanmaz.
  • Satın almayı tamamlayarak Alıcı, dijital hizmetin anında teslim edildiğini kabul eder ve cayma hakkından feragat eder.

İade talepleri için kullanıcılar, ödemeler bu platformlar tarafından işlendiğinden doğrudan Apple veya Google destek kanallarıyla iletişime geçebilir.

9. Hizmet Erişilebilirliği

  • Two Type Studio kesintisiz hizmet sunmayı hedefler ancak %100 çalışma süresi garantisi vermez.
  • Planlı bakım ve güncellemeler hizmet erişilebilirliğini geçici olarak etkileyebilir.
  • Hizmet Sağlayıcı, makul bildirimde bulunarak özellikleri değiştirme, güncelleme veya kaldırma hakkını saklı tutar.

10. Kullanıcı Sorumlulukları

  • Kullanıcıların en az 13 yaşında olması veya ebeveyn/veli onayına sahip olması gerekmektedir.
  • Kullanıcılar hesap güvenliğinden sorumludur.
  • Hizmet, yürürlükteki yasalara ve Kullanım Koşullarına uygun olarak kullanılmalıdır.
  • Kullanıcı, Baby Timeline'ın sadece bilgilendirme ve takip amaçlı olduğunu ve profesyonel tıbbi tavsiye yerine geçmediğini kabul eder.

11. Sorumluluk

  • Büyüme verileri ve gelişimsel bilgiler referans amaçlıdır ve değişkenlik gösterebilir.
  • Two Type Studio, uygulamadaki verilere dayanarak alınan sağlık kararlarından sorumlu değildir. Herhangi bir sağlık endişesi için çocuk doktoruna danışınız.
  • Azami sorumluluk, önceki 12 ayda abonelik için ödenen tutarla sınırlıdır.

12. Uyuşmazlık Çözümü

  • Bu Sözleşmeden doğan uyuşmazlıklar karşılıklı müzakere yoluyla çözümlenecektir.
  • Müzakere başarısız olursa, uyuşmazlıklar bağlayıcı tahkim veya Hizmet Sağlayıcının yargı alanındaki yetkili mahkemelerce çözümlenecektir.
  • Bu Sözleşme, geçerli uluslararası tüketici koruma yasalarına tabidir.
